Distance Selling Regulations (Mail Order System)

Distance selling means selling and buying by phone, mail order via the internet or digital TV. Such transactions are covered generally by normal buying and selling legislation. But they are also covered by special distance selling regulations.

Distance Selling Regulations give protection to consumers who shop by phone, mail order via the internet or digital TV. The protection includes;

  • The right to receive clear information about goods and services before deciding to buy.
  • Confirmation of this information in writing
  • A cooling off period of seven working days in which the consumer can withdraw from the contract:
  • Protection from credit card fraud

  • The Distance Selling Regulations apply to both goods and services, where the contract is made without any face-to-face contact between supplier and consumer.
  • Certain goods and services are exempt from all or part of the regulations.
  • The Office of Fair Trading, Trading Standards Departments of local authorities in England, Scotland and Wales http://www.tradingstandards.uk/ and the Department of Enterprises, Trade & Investment in North Ireland ( https://www.detini.gov.uk/ ) are the designated enforcement authorities for these regulations.
  • The main provisions of the regulations are that:
    • Consumer must be given clear information about the goods or services before buying
    • Goods must be delivered within 30 days unless agreed otherwise
    • Consumers have a cooling off period in which they can withdraw from the contract for any reason. The cooling off period begins with as soon as the order placed. In case of goods, it ends seven working days after the day of receipt of goods. In case of service, it ends seven working days after the day the order were made. If the consumer agrees to the service beginning within the seven days, the right to cancel ends when the service stars and
  • Where consumer notify the supplier in writing or another durable medium that they wish to cancel the contract, they must be refunded within 30 days all money paid.

Lakeland Terms and Conditions

  • Goods must be returned to Lakeland within the 7 days “cooling off “period for exchange or refund. Lakeland does not pay for the refund postage. Goods can be returned via the Royal Mail parcel post service and must be packed correctly and a “free” certificate of posting must be obtained as proof of postage back to Lakeland. However if there is any mistake on the order made by Lakeland e.g we sent the wrong size/style, then we will refund the return postage. We may also send a dispatch return label for a courier but this will incur a charge.
  • On the rare occasion of any claim for faulty manufacturing, the goods will be examined by Lakeland. Please contact us by phone and we will give instructions. Goods are to be returned at the customer expenses but this cost will be refunded if we agree it is a genuine manufacturing complaint. We reserve the right to either send another pair of shoes/boots or give a refund/credit if it is warranted.
  • We reserve the right to only pass a partial refund/credit should the boots/shoes have had a certain amount of wear and tear. In our opinion the reason to return any of our products as “not fit for purpose” will not apply after a reasonable amount of wear and tear.
  • We have made every effort to accurately represent the colors of the products on the Website. However as colors vary between monitors and operating systems, we cannot guarantee that the colors that appear on your screen accurately reflect the actual colors of products.
  • For all online orders, credit/debit card details are not held on our computers or servers as it will be processed through Pay Pal.
  • For phone orders – Credit card details are not held on our computers at any time as we still operate a manual merchant services system.
  • We deem the contract of sale not to be completed until final delivery has been made by the buyer.
  • Specification of product may vary against previous purchases or the catalogue.
  • Packing is mainly in polybags.

 

Note

  • We do not accept any footwear as a manufacturers fault if they have been worn in a stirrup, with a metal gaiter or used with any attachment.
  • Driving vehicles in rubber boots can be hazardous as the boots may slip on the vehicle pedals. We cannot be held responsible should you ignore this recommendation. Equally the driving action of the feet whilst wearing the boots can cause premature failure of the rubber vamp and sole owing to undue and unnatural pressure on the rubber we do not accept complaints of faulty manufacturer owning to this action.
